TERMS OF USE

By use of this site, you agree to the following terms of use for SI® Funeral Services, Wilbert Funeral Services® and Doric® Products.

  1. Every time you use one of Wilbert Funeral Services, Inc.'s registered trademarks, the federal registration symbol, ®, should immediately follow the trademark. You should also identify that "[the trademark] is a federally registered trademark of Wilbert Funeral Services, Inc. Used with permission." Every time you use one of Wilbert Funeral Services, Inc.'s non-registered trademarks, the trademark symbol, ™, should immediately follow the trademark. You should also identify that "[the trademark] is a trademark of Wilbert Funeral Services, Inc. Used with permission."
  2. You will only use a Wilbert Funeral Services, Inc. (WFSI) trademark in its full, proper form.
  3. Every time you use any images, text language, or other work belonging to WFSI, you should always use the legend "© Wilbert Funeral Services, Inc. All Rights Reserved. Used with permission." This legend should appear in immediate proximity to your reproduction of the work. Any WFSI image, text language or any other work belonging to WFSI cannot be altered in any way.
  4. You may only use WFSI's trademarks and copyrights in connection with the sale of genuine WFSI products.
  5. You acknowledge the validity of WFSI's registered and common law trademarks (and the goodwill contained therein) and copyrights and you agree not to challenge the validity of any of WFSI's registered and common law trademarks (and the goodwill contained therein) and copyrights.
  6. WFSI can withdraw its permission at any time for any reason at its sole discretion without any warning and may consider alternatives to protect its rights, including but not limited to, litigation, seeking monetary damages, injunctive relief and even termination of your license agreement. If permission is withdrawn, upon notice, you shall immediately cease and desist from all use of WFSI's trademarks, copyrights and any of its additional intellectual property by immediately taking all steps necessary to remove them from anything under your control, including but not limited to, the intranet, Internet, print advertising, catalogs and web sites. You shall also return this CD-ROM (and all copies whether authorized or not) of WFSI's materials.
  7. You will never use WFSI's registered or common law trademarks or copyrighted images in any manner whatsoever that is likely to cause confusion, or to cause mistake, or to deceive as to affiliation, connection or association any of WFSI's genuine products with other companies' products.
  8. You will never use WFSI's registered or common law trademarks in any manner whatsoever that is likely to cause dilution of the distinctive quality of the trademarks.
  9. This agreement constitutes the entire agreement between the parties and may not be changed orally, but only by an agreement in writing signed by the party against whom enforcement is sought.
  10. The laws of the State of Illinois shall govern this agreement. You consent to personal jurisdiction in Illinois to enforce this agreement.
  11. If any part of this agreement is held unenforceable or invalid, it shall not affect the enforceability of the other parts of the agreement.
  12. This agreement is effective on the date of the last signature.
  13. Nothing contained herein shall be construed in any way to create any relationship between you and WFSI. Nothing contained herein shall be construed in any way as an assignment or grant of a license under any intellectual property rights owned by WFSI in its copyrights, trademarks, trade dress or any other intellectual property right, either now owned or acquired in the future by WFSI.
